Terms of Service

These Terms of Service ("Terms") govern your access to and use of ShipRGB (the "Service"), an AI image generation platform. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ShipRGB routes text prompts to third-party AI image models and returns generated images. Available models, pricing, and limits may change at any time. We do not guarantee that any specific model, output quality, or availability will be maintained.

2. Accounts

Some features require an account. You must provide a valid email address and may be required to verify it before receiving credits. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to register.

3. Credits, Plans, and Billing

The Service uses credits and optional subscriptions. Paid generations deduct credits; failed generations are refunded automatically. Payments are processed by our third-party payment provider acting as merchant of record; your purchase is also subject to their terms. Prices may change with prospective effect. Credits do not expire but have no cash value and are non-transferable. Refund eligibility is described in our Refund Policy.

4. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

• is unlawful, infringing, defamatory, or violates the rights of others;
• depicts minors in a sexual manner, or is otherwise sexually exploitative;
• impersonates real individuals to deceive, or generates misleading deepfakes;
• harasses, threatens, or promotes violence or discrimination;
• attempts to bypass usage limits, free-tier caps, or security controls, or to reverse engineer the Service.

We may suspend or terminate accounts that violate these rules.

5. Your Content and Generated Images

You are solely responsible for the prompts you submit and for your use of any output. Subject to your compliance with these Terms and applicable law, you own the images you generate, to the extent such ownership is permitted by the underlying model providers and law. Because generative models are probabilistic, we do not warrant that output is unique or non-infringing. You grant us a limited license to process and store your prompts and outputs as needed to operate and improve the Service.

6. Intellectual Property

The Service, including its software, design, and trademarks, is owned by ShipRGB and protected by law. These Terms do not grant you any right to our branding except as necessary to use the Service.

7. Third-Party Services

The Service relies on third-party model providers, payment processing, storage, and email delivery. We are not responsible for the availability or actions of these providers, and your use may be subject to their terms.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, ShipRGB shall not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim shall not exceed the amount you paid to us in the three months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to comply with law. Provisions that by their nature should survive termination will survive.

11. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Continued use after changes constitutes acceptance.
